Welcome to ikandigraphics.com, we offer a platform that provides high-quality Ai generated images for various purposes. We provide digital content such images, video, and other digital media, and we will refer to the content we provide as ‘digital content’ throughout the remainder of this document.

By downloading or purchasing our ‘digital content’ you agree with and accept the following terms and conditions:

License Types

When accessing our ‘digital content’ there are two types of licenses that can be applied, we have a ‘Standard License’ and ‘Commercial License’ for extended commercial use. Please see our terms and conditions for both license agreements below:

STANDARD LICENSE

What are you allowed to do with our ‘digital content’ under the terms of our Standard License?

Subject to the Prohibited Uses (see below), our ‘Standard License’ allows users to:

(1) Use our ‘digital content’ for personal and educational use.

(2) Use our ‘digital content’ for commercial purposes, which includes the following: Business websites, social media, business email campaigns or presentations.

(3) Use our ‘digital content’ without having to attribute the author. (Although giving credit is always appreciated by our team!)

(4) Modify or adapt our ‘digital content’ into new works.

What are you not allowed to do with our ‘digital content’ under the terms of our Standard License?

We refer to these as Prohibited Uses which include:

(1) You cannot sell or distribute our ‘digital content’ (either in digital or physical form) on a standalone basis. Standalone means where no creative effort has been applied to the ‘digital content’ and it remains in substantially the same form as it exists on our website.

(2) Create and or print multiple copies of the ‘digital content’ for the purpose of re-sale, profit and or the manufacturing of goods.

This includes the following: Manufacturing or printing of any design concept(s) which include clothing, vehicles, furniture, character design, household items, electronics, general goods, tattoo designs or any new product design concept(s) of any kind, featured within our ‘digital content’.

(3) If the ‘digital content’ contains any recognisable trademarks, logos or brands, you cannot use that ‘digital content’ for commercial purposes in relation to goods and services. Therefore, you cannot print that ‘digital content’ on merchandise or other physical products for sale.

(4) You cannot use ‘digital content’ in any immoral or illegal way, especially ‘digital content’ which features recognisable people.

(5) You cannot use our ‘digital content’ in a misleading or deceptive way.

(6) You cannot use any of the ‘digital content’ as part of a trademark, design-mark, tradename, business name or service mark.

COMMERCIAL LICENSE

(1) Use our ‘digital content’ for personal and educational use.

(2) Use our ‘digital content’ for commercial purposes, which includes the following: Business websites, social media, business email campaigns or presentations.

(3) Use our ‘digital content’ without having to attribute the author (Although giving credit is always appreciated by our team!)

(4) Modify or adapt our ‘digital content’ into new works.

(5) Create and or print single or multiple copies of our ‘digital content’ for the purpose of re-sale, profit and or the manufacturing of goods.

Please be aware that certain ‘digital content’ may be subject to additional intellectual property rights (such as copyrights, trademarks, design rights), moral rights, proprietary rights, property rights, privacy rights or similar.

It is your responsibility to check whether you require the consent of a third party or a license to use our ‘digital content’. Not abiding by the terms and conditions within this document may lead to legal action brought against you.

Display & Accuracy

Ikandigraphics.com is committed to providing accurate and reliable information about the images provided and or sold on its platform. However, we cannot guarantee that your computer’s monitor will display colours and images accurately. Therefore, ikandigraphics.com hold no responsibility for any images that display differently between electronic devices.

User Responsibilities and Expectations

You acknowledge that you have read and understood the terms and conditions outlined below. By using our website, you agree to the following:

(5) Comply with all applicable laws and regulations.

(6) You must not under any circumstances seek to undermine the security of the site or any information submitted to or available through it. In particular, but without limitation, you must not seek to access, alter or delete any information to which you do not have authorised access, seek to overload the system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of this site or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the site.

(7) You are solely responsible for any information submitted by you to this site. Restrict Access

No contract subsists until we accept your order. We may choose not to accept your order for any reason. We reserve the right to withdraw any goods/services at any time. We will not be liable to you or anyone else for refusing to accept your order, withdrawing any goods/services or changing any prices. You may only use this site for lawful purposes.

Pricing

Here at ikandigraphics.com we only have two prices for our ‘digital content’, the majority of our ‘digital content’ downloaded/purchased with our ‘standard license’ have no cost applied, some have a cost of £0.99.

Any of our ‘digital content’ purchased with our ‘commercial license’ has a cost of £9.99, which offers the purchaser the ability to print, re-sell, profit from, design or manufacture any of designs, featured within the ‘digital content’ purchased or the ‘digital content’ itself, allowing the purchaser to print, re-sell, profit from, design or manufacture for a twelve month period from the date of purchase, with no limits to the amount of copies or units produced for an entire year.

All prices are subject to change at any time prior to a contract being entered into and are subject to change without notice.

Payment and Security Procedures

All payments are processed through PayPal, which uses industry-standard encryption to ensure secure transactions. We do not store sensitive payment information on our servers with regards to financial transactions.

Intellectual Property Rights

Ikandigraphics.com retains all rights to the images sold on its platform, including copyright and trademark claims. You acknowledge that you have no ownership or right of use to these images.

Limitation of Liability and Disclaimers

We are not liable for any damages or losses arising from the use of our website or images. Our website is provided ‘as is’ without warranties of any kind, express or implied. By downloading or purchasing our digital content you agree with and accept the following terms and conditions:

(1) License Agreement: That you are prohibited to create and or print single or multiple copies of our ‘digital content’ for the purpose of re-sale, profit and or the manufacturing of goods.

Unless you have purchased each item of ‘digital content’ that you would like to profit from, individually and purchased each item with our ‘commercial license’. That you also agree and understand that you would need to purchase our ‘commercial license’ annually for each item of digital content you would like to profit from.

(2) Product Descriptions: Our product descriptions are written by Ai and are only there to give a brief description as to the image represented to you, they are not to be taken literally and by accepting these terms and conditions you agree and accept that ikandigraphics.com will not be held responsible for any false or misleading information within product descriptions and or any other text found on this website as the text is written by Ai. Our team is working continuously to improve our Ai algorithms within this area. However, you accept that they are not to be taken literally, and your purchase is based on the image represented to you alone.

(3) Internet Access: By downloading or purchasing digital content from our website, you agree and accept the following conditions: If the internet access to our website breaks for any reason, during the checkout process, and during this time payment was taken from you but you did not receive your download link(s), due to the loss of internet connection. In these circumstances ikandigraphics.com will not be held responsible for any financial loss to you and you understand that the digital content purchased during these unfortunate circumstances, would need to be purchased again. So please be sure that your internet connection is up and running correctly before entering our checkout process.

(4) Purchase Availability: By accepting these terms and conditions, you agree and accept the following:

During the checkout process, once a successful payment has been made by you, you understand and accept that you have 24 hours to click the download link(s) and accept that if the download link(s) expire after the period of 24 hours after purchasing or the website page that contains your download link has been closed before you had the chance to receive your download(s), you do not hold ikandigraphics.com responsible for any financial loss to you during these unfortunate circumstances. You accept that your order would need to be purchased again.

(5) Returns & Support: Our support team will help guide you through the correct steps towards gaining your purchased ‘digital content ‘. However, we do not provide a refund or accept returns due to the nature of the ‘digital content’ itself, as we have no way to determine whether the item being returned, is not in fact being used by the purchaser. Please be sure to review any ‘digital content’ thoroughly before downloading or purchasing from our website as we do not give refunds or accept returns.

We will always support our customers that fail to receive their download due to a broken website link, in these circumstances we would repair the website link and support our customers with their intended downloads. We will also reward our customer with an ikandigraphics.com voucher worth £3 for each broken link found.

Areas where we cannot support

(1) We cannot support any of our users that require help finding their devices download area, where they have downloaded our ‘digital content’. We just don’t have the capacity to support our customers within this area as we are only a small team.

(2) When downloading/purchasing ‘digital content’ from our website it’s important to note that, If the internet access to our website breaks for any reason, during the checkout process, and during this time payment was taken but you did not receive your download link, due to the loss of internet connection. In these circumstances, ikandigraphics.com will not be held responsible for any financial loss to you and you understand that the ‘digital content’ purchased during these unfortunate circumstances, would need to be purchase again. So please be sure that your internet connection is up and running correctly before entering our checkout process.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these terms shall be resolved through our legal team.
